General Terms and Conditions and House Rules
of Hostel 47, Bautzener Landstraße 47, 01454 Rossendorf/Dresden - hereinafter referred to as Hostel -
§ 1 Scope of application
The terms and conditions apply to contracts in verbal and written form as well as by e-mail for the rental of hostel rooms or beds of the hostel for accommodation, as well as for the other related services of the hostel.
General terms and conditions of the Guest shall not apply. Other agreements shall only be valid if they have been expressly confirmed in writing by the Hostel.
The Hostel reserves the right to make unrestricted use of its domiciliary rights at any time in the event of willful or grossly negligent violation of the house rules by the Guest.
§ 2 Conclusion of contract, partners
The contract shall come into effect upon verbal or written acceptance of the Guest's application by the Hostel. The Hostel is at liberty to confirm the booking in writing.
The registration and booking form must be filled out truthfully and completely.
The contractual partners are the Hostel and the Guest. If a third party makes the booking on behalf of the Guest, the third party shall be liable to the Hostel as joint and several debtor for all obligations arising from the contract, provided that the Hostel has received a corresponding declaration from the third party.
§ 3 Services, Prices, Payment
The Hostel is obliged to keep the rooms/beds booked by the Guest available and to provide the agreed services.
The Guest is obliged to pay the Hostel's applicable or agreed prices for the provision of rooms/beds and other services used by the Guest upon arrival at the latest. This also applies to services and expenses of the Hostel to third parties arranged by the Guest.
For arrivals Monday through Friday after 5 p.m. and on weekends and public holidays, payment must be made in advance by bank transfer.
The agreed prices include the respective statutory VAT.
The prices may be changed by the Hostel if the customer subsequently requests changes to the number of rooms/beds booked, the Hostel's services or the duration of the guests' stay and the Hostel agrees to this.
Invoices without a due date must be paid in full within 10 days of receipt of the invoice. The Hostel is entitled to declare expired claims due at any time and to demand immediate payment. In the case of reminders, a flat-rate reminder fee of EUR 15.00 shall be payable.
§ 4 Withdrawal of the Guest (Cancellation)
Unless otherwise agreed in the contract, the following cancellation deadlines and fees apply:
30 days to 3 days before arrival 50% of the total price is due,

Withdrawal by the guest from the contract concluded with the Hostel requires the Hostel's written consent. If this is not given, the agreed price from the contract must be paid even if the customer does not make use of contractual services. This shall not apply in the event of a breach of the Hostel's obligation to take into account the rights, legal interests and interests of the guest, if the guest can no longer reasonably be expected to adhere to the contract as a result or if the guest has any other statutory or contractual right of withdrawal.

§ 5 Cancellation by the Hostel

§ 6 Provision, handover and return of rooms

Booked rooms are available to the guest from 2 p.m. on the agreed day of arrival. The guest has no right to

At check-in, the accommodation form must be completed with the guest's personal details. This includes name, address, accompanying persons, ID or passport number, e-mail and telephone number.
On the agreed day of departure, the hostel rooms must be vacated by 10.00 a.m. at the latest. After this time, the hostel may charge 80.00 euros for late vacating of the room.
§ 7 Liability of the Hostel
The Hostel shall be liable for its obligations arising from the contract with the diligence of a prudent businessman. Claims of the guest for
damages are excluded.
Excluded from this are damages resulting from injury to life, body or health if the Hostel is responsible for the breach of duty, other damages resulting from an intentional or grossly negligent breach of duty by the Hostel and damages resulting from an intentional or negligent breach of typical contractual duties by the Hostel. A breach of duty by a legal representative or vicarious agent shall be deemed equivalent to a breach of duty by the Hostel.
Should disruptions or defects in the Hostel's services occur, the Hostel shall endeavor to remedy such upon knowledge thereof or upon immediate complaint by the Guest. The guest is obliged to do what is reasonable to remedy the disruption and to minimize any possible damage.
§ 8 Final provisions
Amendments or additions to the contract, the acceptance of the application or these Terms and Conditions for Hostel Accommodation
should be made in writing. Amendments or additions by the guest are invalid. The place of performance and payment is the registered office of the
Hostel. The exclusive place of jurisdiction - also for disputes concerning checks and bills of exchange - shall be the Hostel's registered office.
§ 9 Severability clause
The ineffectiveness of individual provisions
of our General Terms and Conditions shall not affect the
remaining provisions unaffected.
